TERMS AND CONDITIONS

By clicking enrolling your child to our studio you agree to these Terms and Conditions.

1. Purchase Services

1.1. The Website is operated by Grace Bae t/as A Little Bite Studio (ABN 74 241 245 422) of 3cb/3 The Piazza, Wentworth Point, NSW 2127 (A Little Bite Studio). Access to and use of the Website, or any of its associated Workshops or Services, is provided by A Little Bite Studio.

1.2. The Website provides you with an opportunity to book and purchase art programs, parties and workshops (the ‘Workshop’) that have been listed for sale on the Website. The Website provides this service by way of granting you access to the content on the Website (the 'Purchase Services').

2. Personal Information

2.1. By proceeding to purchase a Workshop, you warrant and acknowledge that you are over 18 years.

2.2. When purchasing a Workshop, you will be required to provide personal information such as your name, address and e-mail address.

2.3. You agree that all details that you have provided in completing the purchase are true and correct.

2.4. Your personal information is kept in accordance with the A Little Bite Studio Privacy Policy (‘Privacy Policy’) which can be accessed on the Website.

3. Purchase of Workshops

3.1. In using the Purchase Services to purchase the Workshop through the Website you will agree to the payment of the purchase price listed on the Website for the Workshop (the 'Purchase Price').

3.2. Payment of the Purchase Price may be made through direct deposit, credit card through the available payment provider (the 'Payment Gateway Providers').

3.3. In using the Purchase Services, you warrant that you have familiarised yourself with, and agree to be bound by, the applicable Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Payment Gateway Providers.

3.4. Following payment of the Purchase Price being confirmed by A Little Bite Studio, you will be issued with a receipt to confirm that the payment has been received and A Little Bite Studio may record your purchase details for future use.

3.5. Unless otherwise stated, all amounts are listed in Australian Dollars (AUD) and are GST exclusive, being goods and services tax as defined in A New Tax System (Goods and Services Tax) Act 1999, exclusive amounts.

3.6. A Little Bite Studio reserves the right to accept or reject your order for any reason, including if the requested Workshop is not available.

4. Bookings and Refunds - Workshops

4.1. A Little Bite Studio requires all bookings and purchases for the Workshop to be made via the booking system available on the website (the ‘Booking System’).

4.2. If you choose to create an account with the Booking System, you acknowledge and agree to be bound by the Terms and Conditions of Use, Privacy Policy and other relevant legal documentation provided by the Booking System.

4.3. If you choose to purchase the Workshop you will be bound by the purchase terms and conditions provided at the point of purchase.

4.4. If you choose to purchase the Workshop A Little Bite Studio agrees to perform the services for you for the fees and on the date/s as set out on the Workshop information page and payment page.

4.5. Subject to clauses 4.7 and 4.8, the Workshop is non-refundable.

4.6. If you are no longer able to attend your original booking date for the Workshop, A Little Bite Studio may at its sole discretion, and depending on availability, allow you to alter your booking to allow you to participate in the Workshop on an alternative date. Any request to alter your booking must be made in writing to alittlebitesyd@gmail.com at least 14 days prior to the Workshop commencement date.

4.7. If the Workshop is cancelled by A Little Bite Studio before the scheduled start date and time, for any reason whatsoever, you will receive a full refund of the fees. A Little Bite Studio will communicate with you directly.

4.8. A Little Bite Studio may reschedule the Workshop at any time. If you are not able to attend the new date, you will be provided with a full refund of the fees.

4.9. If you fail to attend a Workshop for any reason, without making prior arrangements with A Little Bite Studio, you will forfeit the session and a refund will not be offered.

4.10. A Little Bite Studio will not be liable for any loss or damage arising from any cancellation, rescheduling or alteration of the Workshop.

5. Participant Substitutions

5.1. If a participant is enrolled in a term-based Workshop, swapping places with another person for individual sessions is not permitted (for example, if you are unable to attend for a particular week, you are not able to give the weekly session to another person).

5.2. If a term has not commenced for a term-based Workshop, a participant may transfer the whole of the enrolment to someone else by making prior arrangements with A Little Bite Studio.

5.3. A participant enrolled in a one-day Workshop may transfer the enrolment to another person upon making arrangements with A Little Bite Studio.

6. Drop-Off and Pick-Up

6.1. Out of respect for participants and tutors, attendees and participants should be punctual for class and dropped off and picked up on time. Please note early drop offs are not permitted as supervision is not available.

6.2. A Little Bite Studio encourages participants to feel comfortable and confident creating independently, accordingly, parents and care givers are not permitted to remain at Workshops. Parents and care givers are welcome to attend one of the local cafes or common areas located nearby whilst waiting for the Workshop to conclude.

7. Lost or Damaged Artwork

7.1. A Little Bite Studio will not be liable to any lost or damages artwork belonging to participants. It is the responsibility of each participant and/or the parent or caregiver to collet artwork at the end of each term. Any uncollected artwork may be removed or disposed of.

8. Teachers

8.1. A Little Bite Studio reserves the right to change teachers from time to time, without notice, due to circumstances beyond the control of A Little Bite Studio.

8.2. Refunds or transfers will not be facilitated due to a change in the teacher of a lass.

8.3. You acknowledge and agree that A Little Bite Studio does not make any undertakings, promises or guarantees as to what teacher will teach a particular Workshop.

9. Art Materials

9.1. A Little Bite Studio uses a wide range of materials at Workshops, including but not limited to; paint, glue, pastel, chalk, clay and other art and craft material. Whilst A Little Bite Studio uses its best efforts to ensure proper use by participants, accidents may occur from time to time due to no fault of A Little Bite Studio.

9.2. You acknowledge and agree that any materials used in a Workshop are not meant for consumption and where applicable, You agree to explain to your child that they are not to consume any materials, and to aways conduct themselves in a safe manner.

10. Photography and Videography

10.1. A Little Bite Studio takes photographs and videos of arts and creations during and after Workshops. You acknowledge and agree that photographs and videos taken during Workshops may be used for A Little Bite Studio’s own purposes, including to educate participants on other Workshops, promotional purposes, marketing, and social media use.

10.2. A Little Bite Studio warrants that it will not sell any photographs or videos taken during a Workshop.

10.3. If you do not wish for photographs or videos of a particular participant’s work to be taken, please advise A Little Bite Studio by email in advance of a Workshop.

11. Behaviour and Anti-Bullying

11.1. A Little Bite Studio expects participants to display respectful and courteous behaviours, and has a zero tolerance policy for bullying.

11.2. You acknowledge and agree that bullying or harassing behaviour will not tolerated.

11.3. If a participant engages in unacceptable behaviour, or bullying or harassing behaviour, the participant may be asked to leave the Workshop and may not be permitted to return, and this will be determined at the sole discretion of A Little Bite Studio.

11.4. Examples of unacceptable behaviour include: verbal abuse, intimidation, discrimination, social media/cyber bullying, harassment, extortion, threats, and acts of physical violence.

12. Health and Safety of Participants

12.1. Students are permitted to bring water to the studio, however please do not use glass bottles. Other food and drink is not permitted.

12.2. Running in the studio is dangerous and not permitted. You acknowledge and agree that, where applicable, you will explain these requirements to your child.

13. Warranty

13.1. A Little Bite Studio will use its best efforts and take all reasonable steps to help participants achieve certain outcomes from the Workshop. However, A Little Bite Studio makes no warranty that the Workshops will meet the requirements for all participants or that all participants will achieve the same results

13.2. The services do come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel this Agreement with A Little Bite Studio and you are entitled to a refund for the unused portion. A major failure with the service is defined by the Australian Consumer Law and includes but is not limited to severe situations where a service is unfit for the purpose it is sold or creates an unsafe situation.

14. Information and Workshop Disclaimer

14.1. Any information provided to you by A Little Bite Studio regarding the use of any Workshop is for educational purposes only. It is your sole responsibility to determine the appropriateness of the Workshops for any particular use or purpose.

14.2. A Little Bite Studio makes no representation, warranty, expressed or implied as to the effect, benefit, or use of the Workshops and takes no responsibility for any results obtained when using the Workshops.

14.3. A Little Bite Studio will not be liable for any damage, loss or any result based on your use of A Little Bite Studio Workshops including subscriptions.

14.4. A Little Bite Studio Workshops contain goods provided by third-party suppliers. You agree that A Little Bite Studio is in no way responsible for the quality of goods, results provided by the use of the goods or any other occurrence resulting from the use of the relevant goods. The warranties and disclaimers of the third-party suppliers apply to the goods.

15. Copyright and Intellectual Property

15.1. The Website, the Purchase Services and all of the related Workshops of A Little Bite Studio are subject to copyright. The material on the Website is protected by copyright under the laws of Australia and through international treaties. Unless otherwise indicated, all rights (including copyright) in the site content and compilation of the website (including text, images of artwork, graphics, logos, button icons, video images, audio clips and software) (the 'Content') are owned or controlled for these purposes, and are reserved by A Little Bite Studio or its contributors.

15.2. A Little Bite Studio retains all rights, title and interest in and to the Website and all related content. Nothing you do on or in relation to the Website will transfer to you:

(a) the business name, trading name, domain name, trade mark, industrial design, patent, registered design or copyright of A Little Bite Studio; or

(b) the right to use or exploit a business name, trading name, domain name, trade mark or industrial design; or

(c) a system or process that is the subject of a patent, registered design or copyright (or an adaptation or modification of such a system or process).

15.3. You may not, without the prior written permission of A Little Bite Studio and the permission of any other relevant rights owners: broadcast, republish, up-load to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the Content or third party content for any purpose. This prohibition does not extend to materials on the Website, which are freely available for re-use or are in the public domain.

15.4. You agree to indemnify and agree to keep indemnified A Little Bite Studio against all liability, losses or expenses incurred by A Little Bite Studio including damage to A Little Bite Studio’s reputation in relation to or in any way directly or indirectly connected with any breach of copyright by you or your agents.

15.5. You agree that you will not permit any use of A Little Bite Studio’ name or misuse of the artworks which would adversely reflect on of discredit A Little Bite Studio’ reputation as an artist, or which would violate the spirit of the artwork.

16. Privacy

A Little Bite Studio takes your privacy seriously and any information provided through your use of the Website and/or the Purchase Services are subject to the A Little Bite Studio Privacy Policy.

17. Mailing List Registration

17.1. You will be given the option to register for the A Little Bite Studio Mailing List (the 'Mailing List').

17.2. As part of the registration process, you may be required to provide personal information about yourself (such as identification or contact details), including:

(a) Email address

(b) Name

17.3. If you choose to register for the Mailing List or SMS List, you agree to receive promotional material, updates and other content from A Little Bite Studio.

18. Indemnity

18.1. You agree to indemnify A Little Bite Studio, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:

(a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with any Content you post through the Website;

(b) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so and any breach by you or your agents of these Terms; and/or

(c) any breach of the Terms.

19. Venue and Jurisdiction

In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales, Australia.

20. Governing Law

The Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of Victoria, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.

21. Independent Legal Advice

Both parties confirm and declare that the provisions of the Terms are fair and reasonable and both parties having taken the opportunity to obtain independent legal advice and declare the Terms are not against public policy on the grounds of inequality or bargaining power or general grounds of restraint of trade.

22. Severance

If any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.
